Immigration and border control. National security and individual freedoms. The fight against terrorism and the protection of fundamental rights. Freedom of expression and the protection of private life. Freedom of religion and non-discrimination. Environmental protection and individual rights. Armed conflicts, international cooperation and treaty obligations.

Across all these areas, a fundamental question arises: what should be done when different legal norms, obligations or legally protected rights give rise to requirements that appear difficult, or even impossible, to reconcile?

These questions lie at the heart of contemporary divergences in international and European law. The issue is no longer simply to determine which rule is applicable, but also to consider how competing obligations can coexist and how the effective protection of fundamental rights can be ensured without disregarding the other requirements arising under international law.

Is the European Court of Human Rights called upon to resolve conflicts between legal norms, to reconcile them… or to learn to live with divergences between different legal orders?

The webinar «Conflits de normes: Quelle réponse de la Cour européenne des droits de l’homme face aux divergences contemporaines? », co-organised by the René Cassin Foundation and the Marangopoulos Foundation for Human Rights, will take place on Wednesday, 30 September at 6:30 p.m. The seminar seeks to examine the issue from legal, practical and forward-looking perspectives, highlighting one of the most significant challenges facing the protection of fundamental rights today.
