Le présent travail analyse les conflits d’obligations internationales, en se concentrant sur ceux opposant la CEDH aux autres engagements internationaux des États parties. La jurisprudence de la Cour révèle une recherche de cohérence et d’harmonisation, sans toutefois s’attarder sur les causes de ces conflits. Cette thèse vise à déterminer s’il existe des règles permettant d’anticiper ces situations en imposant des normes compatibles, et à systématiser les cas de conflits dans la jurisprudence afin d’en identifier les conditions d’apparition et les modalités de gestion. Au-delà de l’analyse des mécanismes d’harmonisation, l’étude propose des solutions de prévention et examine les outils de résolution des conflits liés aux obligations issues de la CEDH. Elle met enfin en perspective les instruments susceptibles d’être mobilisés si la Cour reconnaissait explicitement l’existence de tels conflits.

This book examines conflicts of international obligations, focusing on those between the ECHR and other international commitments of the States Parties. The Court’s case law reveals a search for coherence and harmonisation, without, however, dwelling on the causes of these conflicts. This thesis aims to determine whether there are rules that could anticipate these situations by imposing compatible norms, and to systematise cases of conflict in the case law in order to identify the conditions under which they arise and the modalities of their management. Beyond the analysis of harmonisation mechanisms, the study proposes preventive solutions and examines tools for resolving conflicts linked to obligations arising from the ECHR. It finally highlights the tools that could be mobilised in the future, should the Court explicitly recognise the existence of such conflicts.
